1. Who you are contracting with
Go with Amana is a trading name of [ENTITY] LLC, registered in [STATE] at [ADDRESS]. In these terms, "we" and "us" mean Go with Amana, and "you" means the person making the booking. If you book for other people, you confirm you have their authority and you are responsible for payment for all of them.
2. What we do
We design your trip, arrange it, and book it on your behalf with hotels, riads, drivers, guides and activity operators in Morocco. Those suppliers deliver the travel services themselves. We are responsible for arranging your trip with reasonable skill and care. We are not the operator of the flights, hotels or activities in it.
3. Prices shown on the website
The price the planner shows you is an estimate, generated from typical supplier rates for the standard of trip you selected. It is not an offer and it is not guaranteed. Your binding price is the one on the written itinerary we send you after confirming live availability.
All prices are in US dollars. Flights are not included unless the itinerary says so in writing.
4. Booking and payment
Your booking is confirmed when we have received your deposit and sent you a written confirmation. Until both have happened, nothing is held.
| When | What is due |
|---|---|
| At booking | Planning fee, plus a deposit of [25%] of the trip total |
| [45] days before departure | The remaining balance |
| Booked within [45] days of departure | Full payment at booking |
If the balance is not paid by the due date we may treat the booking as cancelled by you, and the cancellation charges in section 6 will apply.
5. The planning fee
The planning fee covers the work of designing your trip, sourcing suppliers, and arranging and managing the bookings. It is charged separately from the trip price and is shown separately on your invoice.
The planning fee is non-refundable once your written itinerary has been issued, including if you later cancel, and including where a supplier refunds their portion in full. The work it pays for has already been done by that point. If you cancel before we have issued your itinerary, the planning fee is refunded in full.
6. If you cancel
Cancellations must be sent in writing to bookings@gowithamana.com and take effect on the day we receive them.
What you get back depends on what your suppliers release. Many riads, desert camps and private guides in Morocco have their own non-refundable windows, and some are non-refundable from the moment they are booked. We will tell you which parts of your trip carry those terms before you pay.
We will refund whatever we recover from suppliers, less the planning fee and less [any payment processing costs already incurred]. We will show you the supplier responses so you can see what was and was not recovered.
7. If we change or cancel
Occasionally a supplier becomes unavailable. If that happens we will offer you the nearest equivalent at no extra cost. If we cannot deliver a materially equivalent trip, you may accept an alternative or cancel for a full refund of everything paid, including the planning fee.
We are not liable for changes caused by events outside our reasonable control, including weather, strikes, civil unrest, border or airport closures, epidemic, or acts of government.
8. Flights
We do not sell airfare. Where our itinerary suggests routings, that is guidance only. You book directly with the airline or agent and your contract for the flight is with them. We recommend leaving generous connection time and not booking non-refundable airfare until your trip is confirmed in writing.
9. Passports, visas and health
You are responsible for holding a valid passport, meeting Morocco's entry requirements, and arranging any vaccinations you need. Passports generally need validity beyond your return date; check current requirements with your government before you travel. We are not liable if you are refused entry.
10. Travel insurance
Travel insurance is [required / strongly recommended]. It should cover medical treatment, repatriation, cancellation and your possessions. Given the non-refundable elements described above, cancellation cover matters.
11. Conduct and safety
Some experiences carry inherent risk, including camel riding, desert driving, hiking, quad biking and surfing. You take part at your own risk and must follow your guide's instructions. We or our suppliers may remove anyone from an activity whose behavior endangers themselves or others, without refund.
12. Complaints
If something is wrong during your trip, tell us immediately on [WHATSAPP NUMBER] so we can try to fix it while you are still there. Problems raised for the first time after you get home are much harder to resolve. Written complaints should reach us within [28 days] of your return.
13. Liability
Our liability for any claim arising from a booking is limited to the amount you paid us for that booking, except where the law does not allow that limit. Nothing in these terms excludes liability for death or personal injury caused by our negligence, or for fraud.
14. Governing law
These terms are governed by the laws of [STATE], and the courts of [COUNTY, STATE] have exclusive jurisdiction.
15. Seller of Travel disclosures
[Mandatory state disclosures go here once registered. California requires its CST number and Travel Consumer Restitution Fund language on consumer advertising; Florida, Washington and Hawaii each have their own required wording and trust or bonding arrangements.]
